Municipal and Adminstrative Law

 

OVERVIEW of Municipal and Administrative Legal Services:

· Litigate on behalf of municipalities in State and Federal courts
· Draft, review, implement, and enforce municipal ordinances and regulations
· Defend municipalities in wrongful termination, sexual discrimination, and tax appeals
· Ensure compliance with the Connecticut Freedom of Information Act (FOIA)
· Represent municipalities before the FOI Commission
· Negotiate labor agreements and representing towns in arbitration
· Advise charter commissions
· Represent towns before Connecticut administrative agencies
· Advise municipal commissions in the conduct of hearings
· Develop and review contracts for school building construction
· Develop RFPs fand bid specifications or all areas of municipal services
· Procure environmental engineering services for site assessment and abatement of environmental contamination

Fahey & Landolina has a great range of experience working with planning and zoning agencies and defending the actions of those agencies when their decisions are challenged in the state's courts. Our firm has an history of successfully litigating all areas of land use and zoning issues and experience working with municipal conservation commissions and wetlands agencies and with actions before the Connecticut Department of Environmental Protection.

Our legal staff regularly drafts and reviews municipal zoning regulations and ordinances, guiding them through the public hearing process to adoption and enforcement. Fahey Landolina is highly experienced in seeking and obtaining injunctions for the enforcement of zoning regulations. Our firm also has broad experience with the issue of affordable housing issues, in particular, having regulations adopted and implemented.

Fahey Landolina has years of litigation experience in defending municipalities in Federal and State courts in cases involving (but not limited to) wrongful discharge, discrimination cases, tax appeals, environmental claims, eminent domain claims, and inverse condemnation actions. Our firm also coordinates litigation with municipalities' liability insurance carriers and represents municipalities with cases involving uninsured risks. For instance, when municipalities are brought in as co-defendants with third parties, our staff strives to coordinate the Town's defense with the third party's attorney so as to minimize legal costs to the municipality.
